Terms of Service

The Tobacco Estate is operated by Dagaz LLC, a Wyoming limited liability company (“we,” “us”). The Tobacco Estate is a private community for adults. By creating an account or using the site you represent that you are of legal smoking age in your jurisdiction and in all cases at least 18 years old, and that you will provide accurate account information. You are responsible for activity under your account.

Our Community Charter is part of these terms. Conduct that violates the Charter — including listing or trading tobacco or any other prohibited goods — may result in content removal, suspension, or termination at our discretion.

The Marketplace is a venue only. All transactions are conducted directly between members; The Tobacco Estate is not a party to, and does not broker, guarantee, insure, or process payment for, any transaction. Each member is solely responsible for the legality of their own listings and purchases and for all taxes, fees, duties, and shipping costs in their jurisdiction.

Only pipes, cigar accessories (cutters, humidors, lighters, cases), and related gear may be listed or exchanged. Tobacco in any form — including cigars and pipe tobacco — nicotine products, and any age-restricted consumables are strictly prohibited — in listings, comments, and direct messages arranged through the site. We may remove listings and terminate accounts that violate this rule.

Any raffle or giveaway hosted on the Estate must comply with our Official Giveaway Rules, including that no purchase or payment of any kind may be required to enter or win. Raffles that require payment to enter are prohibited. The Estate provides the drawing tool as a convenience and is not the sponsor of member-hosted giveaways.

You own what you post. By posting, you grant The Tobacco Estate a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as needed to operate the service. You represent that you have the rights to what you post. We may remove any content that violates these terms or the law.

We respond to copyright complaints under the DMCA. See our DMCA Policy for how to send a notice. Repeat infringers will have their accounts terminated.

You may stop using the Estate at any time and may request account deletion. We may suspend or terminate accounts that violate these terms, create risk for the community, or for any reason with reasonable notice. Sections 5–10 survive termination.

The Estate is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any member, listing, or item is as described.

To the fullest extent permitted by law, The Tobacco Estate and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from member transactions, member content, or your use of the service. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless The Tobacco Estate and its owners, operators, and affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your transactions with other members, or your breach of these terms.

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

We may update these terms from time to time; the date above reflects the latest version, and material changes will be announced on the site. Continued use after changes take effect constitutes acceptance. Questions: support@tobaccoestate.com.
